End-User License Agreement (EULA)
1. Acceptance of Terms
By downloading, accessing, or using the MentiorMynd® application, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not use the application.
2. License Grant
Dr. Thomas Steinert grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the app for your personal, non-commercial use strictly in accordance with the terms of this EULA.
3. Restrictions
You agree not to, and you will not permit others to, license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the app or make the platform available to any third party.
4. Intellectual Property Rights
The MentiorMynd® application and all intellectual property rights therein are owned by Dr. Thomas Steinert, Ostwender Str. 12, 30161 Hannover, or its licensors and are protected under German and international intellectual property laws. The license granted to you does not transfer any ownership rights of the application to you.
5. Warranty Disclaimer
The application is provided “as is” without any warranties of any kind, either express or implied. Dr. Thomas Steinert disclaims all warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. This disclaimer also extends to any third-party services or content that may be accessed through the app, which are provided “as is” and without warranties of any kind.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Dr. Thomas Steinert be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of the use of or inability to use the application, including but not limited to damages for loss of profits, data, or other intangible losses.
7. No Guarantee of Specific Results
While MentiorMynd® aims to improve your cognitive and communication skills through consistent use, we do not guarantee specific outcomes, as results may vary depending on individual effort, consistency, and other factors. The app is a tool for personal and professional growth, but success depends largely on how the user engages with the content.
8. Termination
This EULA is effective until terminated by you or Dr. Thomas Steinert. Your rights under this EULA will terminate automatically without notice from Dr. Thomas Steinert if you fail to comply with any terms of this EULA. Upon termination, you must cease all use of the application and delete all copies, full or partial, of the application from your devices. Dr. Thomas Steinert reserves the right to terminate your access to the application for any reason, including violations of this EULA.
9. Governing Law
This EULA shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. This EULA does not override any mandatory statutory rights that cannot be excluded under local law.
10. Salvatorical Clause
If any provision of this EULA is found to be unenforceable or invalid under any applicable law, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. If necessary, one requirement may be replaced or amended by another regulation, and both parties agree to a salvatorical solution if one of the requirements is not fully or partly met.
